根據現時移民規則 (Immigration Rules)，BN(O)簽證持有人的18歲以下的子女如需透過BN(O)簽證政策申請永居－－申請人必須是最近以BN(O)身份持有人家屬身份或BN(O)家庭成員身份作為受養子女獲批簽證。
Children under 18 - The applicant must have last been granted permission as a dependent child on the BN(O) Status Holder route or the BN(O) Household Member route.

申請人的至少一名父母或祖父母必須在其子女或其孫子女申請永居的同時，以香港BN(O)路線獲批永居、已取得永居或是已經成為英國公民。另一名父母必須在同時獲批永居、已取得永居或是已經成為英國公民，除非符合以下其中一項例外情況：

• 其中一名父母已去世

• 其中一名父母對孩子的撫養有唯一責任

• 有嚴重且令人信服的理由需要批准孩子獲得永居

嚴重且令人信服的理由必須根據個案逐一評估。

At least one parent of the applicant must be being granted settlement on the Hong Kong BN(O) route at the same time as their child or grandchild, or be settled, or a British citizen. Their other parent must be being granted settlement at the same time, be a British citizen, or be settled, unless one of the following exceptions apply:

• one parent is deceased

• one parent has sole responsibility for the child’s upbringing

• there are serious and compelling reasons to grant the child settlemen

申請人的父母必須為孩子在英國的照顧和住宿作出合適安排，並且必須符合相關的英國法律和規例。
There must be suitable arrangements for the child’s care and accommodation in the UK, which must comply with relevant UK legislation and regulations.

孩子通常必須與主申請人同住，除非他們：

• 因求學而離家居住

• 在主申請人已經移居英國後才申請BN(O)簽證
   

The child must normally live with you, unless they’re either:

• living away from home to study

• applying after you’ve already moved to the UK

以BN(O)身份持有人家屬身份或BN(O)家庭成員身份作為受養子女，只要年滿18歲就可以獨立於其BN(O)主申請人申請永居。

根據內政部指引，如果個案工作人員對是否批准有疑問，必須諮詢高級個案工作人員。他們可能會將個案轉介至BN(O)路線政策團隊以獲得進一步指引。
Serious and compelling reasons must be assessed on a case-by-case basis. You must consult your senior caseworker if you have doubts about granting. They may refer you to the BN(O) Route Policy team for further guidance.
